4. Loan Availability and Qualification
4.1 No Guarantee of Approval
BD Nationwide does not guarantee that any consumer will be approved for a mortgage loan, offered any specific terms, or matched with any specific lender. All credit decisions, including loan approval and the conditional rates and terms offered, are the sole responsibility of participating licensed lenders. Loan approval depends on:
- Credit score and credit history
- Loan-to-value ratio
- Debt-to-income ratio
- Employment and income verification
- Property appraisal and eligibility
- Cash reserves
- Individual lender underwriting standards
4.2 Consumer Information Is Not a Credit Application
Information submitted through Site forms is used for referral purposes only and does not constitute an application for credit or a mortgage loan. Submission of Site forms does not:
- Pre-qualify you with any lender
- Constitute a loan application
- Generate a credit report inquiry by BD Nationwide
- Guarantee lender contact or loan offer
4.3 Consumer Matching
Information you submit may be shared with up to four (4) licensed mortgage professionals in our participating network. You may not be matched with any specific lender, and BD Nationwide does not guarantee that any participating lender will contact you or make a loan offer.

Consumers should confirm the specific fixed-rate period with participating lenders — some products have fixed rates for the entire loan term while others have fixed rates only for an initial period followed by adjustable rates.
8.2 Adjustable Rate Mortgage (ARM) Disclosure
If considering an adjustable rate mortgage (ARM), consumers should understand:
- When the initial rate expires (typically 3, 5, 7, or 10 years)
- How and how often the rate can change (typically annually after initial period)
- The index used for rate adjustments (SOFR replaced LIBOR as standard ARM index in 2023)

15.1 “AS IS” Basis

18. Fair Credit Reporting Act (FCRA) Notice
BD Nationwide is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. Information submitted through the Site is used for referral purposes only and does not generate a credit report inquiry by BD Nationwide. Participating lenders may obtain credit reports as part of their loan approval process, subject to your authorization.
19. CAN-SPAM Compliance
BD Nationwide complies with the CAN-SPAM Act. All commercial email communications from BD Nationwide include:

- Clear identification as advertising when applicable

- An operational unsubscribe mechanism
20. Dispute Resolution and Arbitration
20.1 Binding Arbitration
Any dispute regarding these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in San Diego, California, under the AAA’s Consumer Arbitration Rules. To initiate a claim:
- First, provide written notice of the claim to BD Nationwide within thirty (30) days of learning of the potential claim
- Following such notice, the claim must be submitted to the American Arbitration Association within thirty (30) days
- Arbitration shall be resolved formally within a reasonable time period as determined by the AAA rules
By using the Site, you agree that this dispute resolution process is fair and reasonable, and you waive your right to a jury trial or to participate in a class action arbitration or class action lawsuit.
20.2 Small Claims Exception
Notwithstanding the arbitration provision above, either party may bring an individual action in small claims court for disputes within that court’s jurisdiction.
20.3 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

23. Miscellaneous Provisions
